At A Mother’s LLC (“A Mother’s”, “we”, “our”, or “us”), we respect the privacy and are committed to protecting it through our compliance with this Privacy Policy.

This Privacy Policy describes the types of information we may collect from you or that you may provide when you access or use our website, hosted services, software, or any other products or services (our “Services”) and our practices for collecting, using, and sharing that information.

2. Consumer Health Data

Certain information may constitute consumer health data under RCW 19.373, including lactation status, health verification documents, nutritional information, and infant-related information. A Mother’s does not sell consumer health data.

3. How We Use Information We Collect

We may use information to operate the Services, facilitate transactions, verify identities, provide customer support, process payments, communicate with users, prevent fraud, preserve evidence, comply with legal obligations, and establish, exercise, or defend legal claims.

We also use the information we collect to provide, maintain, and improve the Services, to develop services, and to protect A Mother’s LLC and our users. We also use the information to communicate with you, for example, to respond to your questions or requests and inform you about your account, any upcoming changes or improvements of the Services, and any new products, services or other information that you might be interested in.

4. Disclosure of Information

A Mother’s does not sell personal information. Information may be disclosed to service providers, payment processors, cloud providers, communication providers, legal authorities where required, and parties involved in corporate transactions.

5. Third-Party Providers

The Services utilize third-party providers including payment processors, cloud hosting providers, SMS verification providers, email providers, notification providers, and geolocation providers.

6. User Communications

Messages exchanged through the Services are not end-to-end encrypted. Authorized personnel may access, review, preserve, and disclose communications where reasonably necessary for customer support, safety, fraud prevention, legal compliance, enforcement of agreements, or protection of rights.

7. Data Retention

A Mother’s retains information as reasonably necessary to fulfill business purposes, comply with applicable law, resolve disputes, preserve evidence, and enforce agreements. Communications may be retained for up to five years following account closure. Verification records may be retained for up to seven years. Financial and transaction records may be retained for up to seven years or longer where reasonably necessary or permitted by law.

8. Account Deletion

Users may initiate account deletion through the Services. Account deletion may result in account deactivation. Users may request permanent deletion by contacting info@amothers.org. Verified deletion requests are generally processed within sixty (60) days, subject to legal, regulatory, accounting, fraud prevention, and evidence preservation requirements.

9. Security

A Mother’s implements administrative, technical, and physical safeguards designed to protect information from unauthorized access, use, disclosure, alteration, and destruction. However, no method of transmission over the Internet, electronic storage system, or security measure can guarantee absolute security.

10. Age Requirement and No Information from Children

Our Services are not intended for users under eighteen (18) years of age, and we do not knowingly collect information from them. If you are under 18, please do not use or access our Services at any time or in any manner.

11. Applicability of our Privacy Policy

This Privacy Policy applies only to our Services that has a link to it. If you go to a third-party website, application, or other product or service from our Services, please note that such third-party product or service may collect your information and have their own privacy policies. A Mother’s LLC does not control those products or services, and this Privacy Policy does not apply to those external products or services and/or third parties.

12. California Privacy Rights

California residents may have rights to access, correct, delete, and obtain information concerning personal information collected about them, subject to applicable law.

13. Washington Consumer Health Data Rights

Individuals may have rights under the Washington My Health My Data Act, including rights relating to access, deletion, withdrawal of consent, and information concerning consumer health data collected and shared.

14. International Transfers

The Services are intended for users located in the United States. Information is primarily stored in the United States, although limited information may be processed by certain service providers outside the United States.

15. Changes to this Policy

A Mother’s reserves the right to modify this Privacy Policy at any time. Material changes become effective upon posting or other notice deemed appropriate by A Mother’s.

16. Reservation of Rights

A Mother’s reserves the right to preserve, investigate, monitor, access, review, use, disclose, retain, and produce information where reasonably necessary to comply with law, preserve evidence, prevent fraud, protect rights and safety, enforce agreements, or defend legal claims.

17. No Creation of Special Duties

This Privacy Policy is intended solely to provide notice regarding information practices and shall not be construed to create fiduciary duties, warranties, guarantees, or obligations beyond those imposed by applicable law.

18. Severability

If any provision of this Privacy Policy is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
